29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about August 11, 2017, the employer failed to report the hospitalization of an employee in a timely manner. The employee had been involved in an altercation with another employee at work and was stabbed in the face and neck by the other employee. The incident occurred on August 7, 2017, at 5:45 PM, and was not reported by the employer to OSHA until August 11, 2017, at 2:48 PM.
