29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a)Quinn Process Equipment Company at 3400 Brighton Blvd, Denver, CO: On and before August 14, 2017, the employer did not develop, implement, and maintain at the workplace a site specific written hazard communication program.  Employees are potentially exposed to hazardous chemicals, including but not limited to the following:  1) Argon compressed gas 2) Slugger Cutting Fluid 3) Rustlick 631 4) Anti-Spatter Aerosol 5) Gloss Protective Enamel 6) Rusty Metal Primer

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical:  (a) Quinn Process Equipment Company at 3400 Brighton Blvd, Denver, CO: On and before August 14, 2017, the employer did not maintain the required safety data sheets for each hazardous chemical in the workplace. The employer had not updated material safety data sheets to safety data sheet under the Globally Harmonized System. This condition exposed employees to chemical hazards.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a) Quinn Process Equipment Company at 3400 Brighton Blvd, Denver, CO: On and before March 17, 2017, the employer did not provide employees with effective information and training on hazardous chemicals in their work area.  Employees did not know the hazards of the chemicals in their work areas. This condition exposed employees to chemical hazards, including but not limited to Argon Compressed gas, Slugger Cutting Fluid, Rustlick 631, Anti-Spatter Aerosol, Gloss Protective Enamel, and Rusty Metal Primer.  Abatement Note: Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through Globally Harmonized System labels and safety data sheets.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  (a) Quinn Process Equipment Company at 3400 Brighton Blvd, Denver, CO: On and before August 14, 2017, the employer did not ensure that any employee using a respirator voluntarily was provided with the information contained in Appendix D to this section when the employer determined that any voluntary respirator use was permissible.  The employer provided 3M Model 8211 N95 filtering facepiece respirators for voluntary use.  This condition exposed the employees to a respiratory hazard.

29 CFR 1910.303(g)(1)(i): Work space was less than 30 inches wide in front of electric equipment operating at 600 volts, nominal, or less:  (a) Quinn Process Equipment Company at 3400 Brighton Blvd, Denver, CO: On and before August 14, 2017,  the employer did not maintain a workspace of at leave 30 inches wide in front of four electrical panels located on walls in the northwestern, northeastern, southwestern and southeastern regions of the fabrication shop. The electrical breaker panels were blocked by work benches, equipment, metal sheets and shelving. This condition potentially exposed employee to hazards associated emergency incidents in which equipment and machines must be immediately de-energized.

29 CFR 1910.1026(d)(1): The employer with a workplace or work operation covered by this standard did not determine the 8-hour time-weighted average exposure for each employee exposed to chromium (VI):  (a) Quinn Process Equipment Company at 3400 Brighton Blvd, Denver, CO: On and before March 25, 2017, the employer did not ensure that employee exposure to chromium (VI) was assessed, while stick welding and hand grinding on stainless steel. An employee was exposed to an eight-hour time weighted average concentration of 4.48 micrograms per cubic meter of chromium (VI) when sampled for 401 minutes. The employee exposure was above the action level but below the permissible exposure limit for chromium (VI).
