29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:    (a)Paradigm Commercial Construction Company, LLC. at 5140 S. Greystone, Sioux Falls SD, 57108:  On and prior to August 10, 2017, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person in that employees were exposed to fall hazards from a 3rd story balcony while installing siding material.         Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a) Paradigm Commercial Construction Company, LLC, at 5140 S. Greystone, Sioux Falls SD, 57108:  On or about and at times prior to August 10, 2017, the employer did not ensure that each employee was protected from falls from heights in that two employees were installing siding on a third floor balcony of a four story apartment complex without fall protection in place.  This condition exposed the employees to a fall hazard of approximately 30 feet.
