29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.) While performing roofing operations the employer did not initiate an adequate safety program that would ensure a safe and healthful working environment. In this case the employee/s were exposed to a fall hazard in excess of nine (9) feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: During tar paper installation on the roof of building one the employer did not ensure that the ladder being utilized to access the roof was extended at least 3 feet above the landing surface of the roof. The ladder was extended approximately 1.25 feet. The employee was exposed to a fall hazard of approximately nine (9) feet from the eave to the ground below.
