29 CFR 1910.134(c)(1):  In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use:  (Construction Reference:  1926.103)    On or about August 16, 2017 at a worksite located at 120 S. Oneida Street, Appleton, WI 54911, the employer, The Boldt Company, did not implement it's written respiratory protection program when the employer required its employees to wear 3M N95 filtering facepiece (dust mask) respirators while chipping, dry saw cutting, handheld hammer drilling and cleaning up concrete of a parking garage structure.     All provisions of 29 CFR 1910.134(c) through (m) must be covered in a written respiratory protection program. Key elements include but are not limited to the following:    1)  Selection of respirators  2)  Medical evaluations  3)  Fit testing  4)  Use, maintenance and care of respirators  5)  Employee information and training  6)  Program evaluations  7)  Recordkeeping

29 CFR 1910.134(e)(1):  The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator:  (Construction Reference:  1926.103)    On or about August 16, 2017 at a worksite located at 120 S. Oneida Street, Appleton, WI 54911, the employer, The Boldt Company, did not provide medical evaluations to determine employees' ability to use respirators when the employer required its employees to wear 3M N95 filtering facepiece (dust mask) respirators while chipping, dry saw cutting, handheld hammer drilling and cleaning up concrete of a parking garage structure.

29 CFR 1910.134(f)(1):  The employer shall ensure that employees using a tight-fitting facepiece respirator pass an appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT) as stated in this paragraph:  (Construction Reference:  1926.103)    On or about August 16, 2017 at a worksite located at 120 S. Oneida Street, Appleton, WI 54911, the employer, The Boldt Company, did not ensure that employees using tight-fitting facepice respirators passed an appropriate fit test when the employer required its employees to wear 3M N95 filtering facepiece (dust mask) respirators while chipping, dry saw cutting, handheld hammer drilling and cleaning up concrete of a parking garage structure.

29 CFR 1910.134(d)(1)(iii):  The employer shall identify and evaluate the respiratory hazard(s) in the workplace; this evaluation shall include a reasonable estimate of employee exposures to respiratory hazard(s) and an identification of the contaminant's chemical state and physical form. Where the employer cannot identify or reasonably estimate the employee exposure, the employer shall consider the atmosphere to be IDLH:  (Construction Reference:  1926.103)    On or about August 16, 2017 at a worksite located at 120 S. Oneida Street, Appleton, WI 54911, the employer, The Boldt Company, did not identify or evaluate respiratory hazards at the worksite when the employer required its employees to wear 3M N95 filtering facepiece (dust mask) respirators while chipping, dry saw cutting, handheld hammer drilling and cleaning up concrete of a parking garage structure. The employer did not conduct air monitoring or an objective determination to identify if employees were exposed to respirable crystalline silica.

Oneida Street, Appleton, WI 54911, the employer, The Boldt Company, did not train employees on the health hazards of respirable crystalline silica generated at the worksite while employees were chipping, dry saw cutting, handheld hammer drilling and cleaning up concrete of a parking garage structure.
