29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:    A)     Construction site, 3041 Central Ave, Ocean City, NJ: Employees did not have a proper means of accessing the aluminum scaffold pick approximately 6 feet above the 1st floor deck, on or about 08/16/2017.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:   A)  2nd level of a 3 story home under construction; 3041 Central Ave, Ocean City, NJ: Employees without any type of fall protection were working at the edges of the upper levels between approximately 10-19 feet above ground level, on or about 08/16/2017. 29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:(a) (LOCATION) (IDENTIFY SPECIFIC OPERATION(S) AND/OR CONDITIONS)  a)  West side:  The Werner Model D 1220-2 Aluminum Extension ladder extended approximately 12-14 inches above the 1st floor level (approximately 12 feet above ground level) being accessed by employees, on or about 08/16/2017. 29 CFR 1926.1053(b)(15): Ladders were not inspected by a competent person for visible defects on a periodic basis and after an occurrence that could affect their safe use:  a)  West side, north corner of structure:  Employees used the damaged Werner Model D 1220-2 Aluminum Extension ladder to access the approximate 10 foot high 1st floor level; damage included bottom right shoe bent in towards the middle of the ladder, on or about 08/16/2017.
