29 CFR 1926.451(e)(6)(vi): Integral prefabricated scaffold access frames being used for access had a maximum spacing between rungs greater than 16 3/4 inches: (a) Lot 33, Front of Home - An employee climbed the integral prefabricated scaffold end frame on the blue scaffold to get to the work platform 13 feet 2 inches above the ground. However, the horizontal members (rungs) on the integral prefabricated scaffold end frame had a vertical spacing of 20 inches, which exceeded the maximum allowable spacing of 16 3/4 inches. The scaffold had no other safe means of access, exposing the employee to the hazard of falling 13 feet 2 inches to the ground below, on or about August 17, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms: (a) Lot 33, Front of Home - An employee worked grouting stone 13 feet 2 inches above the ground from mason frame scaffolding. The work platform had only a top rail along the back side rather than a complete guardrail system consisting of a top rail and an intermediate member, exposing the employee to the hazard of falling to a lower level, on or about August 17, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

The employee did not use fall protection even though the foreman (competent person) determined it was feasible to use a personal fall arrest system during dismantling, exposing the employee to the hazard of falling to the ground below, on or about August 17, 2017. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
