29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   a) On or about April 19, 2017, two (2) employees removing Asbestos roof tiles on a 6:12 pitch roof were not protected from falling 10 feet to the ground by the use of a guardrail system, safety nest system or personal fall arrest system.

29 CFR 1926.1101(e)(5): The employer did not ensure that employees did not eat, drink, smoke, chew tobacco or gum, or apply cosmetics in the regulated area:   a) On or about April 19, 2017, the employer failed to ensure that employees conducting class II asbestos work did not smoke in the regulated area during removal.  b) On or about April 19, 2017, the employer failed to ensure that employees conducting class II asbestos work did not drink in the regulated area during removal.

29 CFR 1926.1101(i)(1): The employer did not provide and require the use of protective clothing, such as coveralls or similar whole-body clothing, head coverings, gloves, and foot coverings for each employee for which a required negative exposure assessment was not produced.  a) On or about April 19, 2017, the employer failed to ensure that full body covering protective clothing was used by the employees when appropriate 8-hour time weighted average and 30-minute short-term exposures to airborne Asbestos of two (2) employees removing Asbestos roof tiles had not been accurately performed by conducting air monitoring of the airborne concentrations of the employees' breathing zone.
