29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.  (a) South side of the building - On or about August 17, 2017 an employee was exposed to a fall hazard while working in an unauthorized open basket with no fall protection 54 feet above the ground on a Sky Trak 10054 Legacy Series Forklift serial no. 412-10-3086. This basket was not designed by the manufacture.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.  (a)  South side of the building - On or about August 17, 2017 an employee was exposed to a fall hazard while working in an unauthorized open basket with no fall protection on a Sky Trak 10054 Legacy Series Forklift serial no. 412-10-3086. This employee was elevated 54 feet above the ground with no guardrails on the front end of the basket.

29 CFR 1926.602(c)(1)(vi): All industrial trucks in use shall meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  (a)  South side of the building - On or about August 17, 2017 an employee was exposed to a fall hazard due to a Sky Trak 10054 Legacy Series Forklift serial no. 412-10-3086 being left elevated and unattended. There was no one at the controls of the forklift while an employee was in a basket 25 feet above the ground.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  (a) South side of the building - On or about August 17, 2017 an employee was exposed to a fall hazard due to no ladder being installed on a scaffold.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  (a) Construction site - On or about August 17, 2017 employees were exposed to a potential fall hazard while working on scaffolds without training on how to erect, disassemble, move, maintain, repair, and inspect these scaffolds. This scaffold was missing safety components such as: no ladder installed. Also the employer stated neither he nor his employees were trained on scaffolds.
