29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. At a residential construction jobsite, an employee was working at heights over 10 feet in a work platform elevated by a Genie Telehandler, Model GTH-844 rough-terrain-forklift, and the operator left the telehandler running and unattended exposing the employee to a fall and struck by hazard.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: At a residential construction jobsite, employees were working from a work platform, elevated by a Genie Tele-handler, Model GTH-844 rough-terrain-forklift, that was not approved and or designed by the manufacturer to be used with the GTH-844 tele-handler. Central Texas Lath & Plaster, LP was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(c)(2)(iv), which was contained in OSHA inspection number 998957, citation number 1, item number 1 and was affirmed as a final order on 12/18/2014 with a final abatement date of 01/02/2015, with respect to a workplace located at 122 Ray Smith, San Antonio, Texas 78215.
