29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying exists:  a.  On or about August 18, 2017, at the above addressed jobsite, an inspection was not conducted by a competent person capable of correcting hazards such as falls, which could result in employee injuries.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a.  On or about August 18, 2017, at the above addressed jobsite, an employee conducting cement board installation was not provided training on how to minimize fall protection hazards, thereby exposing employee to the hazards associated with falls.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    a.  On or about August 18, 2017, at the above addressed jobsite, an employee performing residential cement board installation on a roof, eleven (11) feet nine (9) inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.
