29 CFR 1926.20(b)(2):     Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed roll-over hazards while operating earth moving type equipment:     The employer is failing to protect employees from roll-over hazards associated with defective equipment while engaged in demolition activities. This was most recently documented on or about August 18, 2017, at the jobsite located at 2901 N. Mead Wichita, KS 67219. The employer failed to identify and repair a broken exterior rear view mirror on the Deere EXC-28 Excavator (Serial Number/Product Identification Number - 1FF350GXKDE809229; Model Number - 350G LC) exposing employees to roll-over hazards.    Among other methods, one or more feasible and acceptable abatement methods to correct this hazard would be to establish and to enforce accepted safe practices by a) inspection of equipment and removing equipment with known defects to be removed from service until the equipment can be repaired or replaced, b) repair or replace damaged/broken rearview mirrors, c) instruct operators to report malfunctions or unsafe conditions prior to operation, d) ensure mirrors are adjusted before each use to make sure they are in operational conditions, e) follow the Deere 350GLC Excavator Operator's Manual and perform a thorough walk-around inspection before each use.

29 CFR 1926.859(a): Workers other than only those employees necessary for the performance of demolition operations were permitted in an area, which can be adversely affected by demolition operations, when balling or clamming is being performed:    The employer is failing to protect employees and other contractor personnel from crushing and struck-by hazards associated with demolition activities. This was most recently documented on or about August 18, 2017, at the jobsite located at 2901 N. Mead Wichita, KS 67219. The employer did not provide protective barriers / barricades or signs warning employees and other workers of the hazard of potential falling materials.  A subcontractor employee working in the building entered the northeast portion of the building walked up to and in close proximity of the demolition activity and was struck-by falling building materials.
