OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  On or about August 17, 2017, employees were exposed to struck-by hazards when damaged racks had not been unloaded, repaired or replaced.  Employees drive powered industrial trucks, walk, and work in the area. 29 CFR 1910.22(a)(2): The floor of each workroom was not maintained in a clean and, to the extent feasible, in a dry condition.    On or about August 17, 2017, employees were exposed to struck-by and slip hazards when water condensed on the floor in front of the freezer doors in zones 6 and 7.  Employees walk and drive powered industrial trucks on the wet floors.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.178(n)(8): Under all travel conditions the truck was not operated at a speed that would permit it to be brought to a stop in a safe manner   On or about August 17, 2017, employees were exposed to struck-by hazards when employees were not monitored and/or trained to insure that employees were driving at all times in a way that insured that the vehicle could be brought to a stop safely.  The following warnings are in the Crown reach truck manual: a. Never stick a foot or any part of your body outside the operator area, no matter how slow the truck is moving. You cannot stop 3680 kg (8000 pounds) with any part of your body. A foot or hand caught between the truck and a fixed object will be crushed or even cut off.  b. Look where you are going before you change direction of travel.  c. Slow down when making turns. d. Slow down for wet or slippery floors.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

On or about August 17, 2017, the employer did not use an OSHA 301 form.  The Worker's Comp form that was used in lieu of the OSHA 301 was missing the following information: a. date of birth b. Was employee treated in an emergency room? c. Was employee hospitalized overnight as an in-patient? d. Case number from the Log e.Time employee began work f. What was the injury or illness? 29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  On or about August 17, 2017, employees who came to work at the site after the annual HAZCOM training in March/April did not receive Hazard Communication training before starting to work.  Employees transport ship/receive cleaning products.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
