29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. While performing framing operations the employer did not initiate an adequate safety program that would ensure a safe and healthful working environment. In this case the employees were exposed to a fall hazard of up to eighteen (18) feet from the working surface to the ground below.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. The employer did not ensure that fall protection was utilized while framing operations were being performed on the north side of the building being constructed. Employees were exposed to a fall hazard of up to eighteen (18) feet from the working surface to the ground below.
