OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  On or about August 22, 2017, an employee working from an elevated work platform located at 4890 N. Overland Rd. Hobart, WI 54155 was exposed to stuck-by and fall hazards created by a JCB 506B rough terrain forklift that did not have the truck wheels blocked when the operator was not in the operating position or available to operate the controls.  The rough terrain forklift was parked on a sloping surface toward a retention pond with an employee elevated approximately 13' on a work platform.

29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.  On or about August 22, 2017, the employer did not construct and use a work platform on a JCB Loadall rough terrain forklift as designed when an employee was using it to install fascia and sheathing at 4890 N. Overland Rd. Hobart, WI 54155.  The work platform did not have the guardrails and gates in position and secured as required by the platform manufacturer and it was missing a pin to lock the platform to the left fork.  Jerry Zepnick Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(a)(6), which was contained in OSHA inspection number 959882, citation number 1, item number 1 and was affirmed as a final order on May 20, 2014, with respect to a workplace located at 279 East St. Joseph St. Green Bay, WI 54301.
