29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).      On or about August 22, 2017, at a trenching site located at the corner of E. Pine and N. Birmingham Avenue in Tulsa, Oklahoma, no protective devices were in place to protect employees working in a trench that was more than 5 feet in depth, exposing employees to the hazard of being crushed by falling soil.      McGuire Brothers Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 954712, citation number 1, item number 4, and was affirmed as a final order on March 7, 2014, with a final abatement date of February 21, 2014, with respect to a workplace hazard located at 1212 W. 4th Ave. Stillwater, OK 74074.      McGuire Brothers Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1046012, citation number 1, item number 1, and was affirmed as a final order on April 28, 2015, with a final abatement date of April 30, 2015, with respect to a workplace hazard located at 121st and S. Orbana, Bixby, OK 74008.      McGuire Brothers Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1121612, citation number 1, item number 1, and was affirmed as a final order on April 21, 2016, with a final abatement date of April 15, 2016, with respect to a workplace hazard located at 55th Place and Yale in Tulsa, OK 74008.      McGuire Brothers Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1152088, citation number 2, item number 1, and was affirmed as a final order on September 12, 2016 with a final abatement date of August 26, 2016, with respect to a workplace hazard located between Hwy 169 North between 36th St. N and Apache in Tulsa, OK 74008.
