OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall, struck-by and caught-between hazards: (a)Siteworks, LLC at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110: On an prior to August 22, 2017, the exposing employer utilized the bucket of a Volvo EC 330C excavator to lower and raise an employee approximately 20-feet into an excavation. This condition exposed the employee to fall, struck-by, and caught-in-between hazards. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard can be found in SAE J153, Surface Vehicle Recommended Practice, Section 4.2 Operator- General Precautions, instructs operators: "Do not permit riders on the machine if there are no manufacturer's designated place for a rider."

29 CFR 1926.602(a)(9)(ii): No employer shall permit earthmoving or compacting equipment which has an obstructed view to the rear to be used in reverse gear unless the equipment has in operation a reverse signal alarm distinguishable from the surrounding noise level or an employee signals that it is safe to do so: (a)Siteworks, LLC at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110: On an prior to August 22, 2017, the exposing employer did not utilize the reverse signal alarm when operating a Volvo EC 330C excavator with employees performing work behind the excavator. The owner/operator had disabled the alarm within the excavator cab while operating. This condition exposed employees to struck-by hazards when performing work behind the excavator.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: (a)Siteworks, LLC at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110: On and prior to August 22, 2017, the exposing employer did not ensure a means of egress was available for employees working in an excavation with a depth of four feet or greater. Employees were not provided a safe means of egress and had to climb up and down the slope of the excavation and were also lowered into the excavation by the excavator bucket. This condition exposed employees to caught-in and struck-by hazards as a result of climbing in and out on the slope of the excavation.

29 CFR 1926.651(h)(1): Employees shall not work in excavations in which there is accumulated water, or in excavations in which water is accumulating, unless adequate precautions have been taken to protect employees against the hazards posed by water accumulation: (a)Siteworks, LLC at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110: On and prior to August 22, 2017, the exposing employer directed employees to perform work in an excavation where water was accumulating. Employees were attempting to uncover an existing sewer main to install a Smith Tap while exposed to cave-in hazards. The condition related to the presence of water exacerbated existing cave-in conditions within the excavation and exposed employees to struck-by and caught-in-between hazards when performing work in a excavation approximately 20-feet in depth.

29 CFR 1926.652(a)(1): The employer did not ensure each employee in an excavation was protected from cave-ins by an adequate protective system: (a)Siteworks, LLC at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110: On and prior to August 22, 2017, the exposing employer did not ensure that each employee conducting work in an excavation was protected from cave-in, in that the excavation was approximately 20-feet deep and lacked an adequate protective system, such as appropriate sloping, benching, or shield system. Employees had accessed the trench excavation to located an existing pipe and install a Smith Tap. This condition exposed two employees to cave-in and struck-by hazards when performing work in a 20-feet deep excavation.

This condition exposed the employee to struck-by and caught-in-between hazards when performing work in the excavation at an approximate depth of 20-feet.
