OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall, struck-by and caught-between hazards:  (a)Siteworks, LLC at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110: On an prior to August 22, 2017, the exposing employer utilized the bucket of a Volvo EC 330C excavator to lower and raise an employee approximately 20-feet into an excavation. This condition exposed the employee to fall, struck-by, and caught-in-between hazards.   Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard can be found in SAE J153, Surface Vehicle Recommended Practice, Section 4.2 Operator- General Precautions, instructs operators: "Do not permit riders on the machine if there are no manufacturer's designated place for a rider."

29 CFR 1926.652(a)(1): The employer did not ensure each employee in an excavation was protected from cave-ins by an adequate protective system:  (a)Siteworks, LLC at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110: On and prior to August 22, 2017, the exposing employer did not ensure that each employee conducting work in an excavation was protected from cave-in, in that the excavation was approximately 20-feet deep and lacked an adequate protective system, such as appropriate sloping, benching, or shield system.  Employees had accessed the trench excavation to located an existing pipe and install a Smith Tap. This condition exposed two employees to cave-in and struck-by hazards when performing work in a 20-feet deep excavation.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  (a)Siteworks, LLC at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110: On and prior to August 22, 2017, the exposing employer did not ensure a competent person inspected the excavation prior to start of work and during each shift, in that the competent person did not identify the lack of an appropriate protective system and did not take prompt corrective action to eliminate the cave-in hazard.  This condition exposed the employee to struck-by and caught-in-between hazards when performing work in the excavation at an approximate depth of 20-feet.

29 CFR 1926.1053(b)(16): The employer did not ensure portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were immediately marked in a manner that readily identified them as defective, or be tagged with "Do Not Use" or similar language, or withdrawn from service until repaired.    (a)Siteworks, LLC at the intersection of Arrowhead Parkway and South Powder House Road, Sioux Falls, SD 57110: On and prior to August 22, 2017, the exposing employer did not ensure the upper portion of a two-part extension ladder used without the lower portion was removed from service. This condition exposed employees to fall hazards of up to approximately 12-feet.
