29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) NGA Home Repairs LLC at 2010 W. 120th Ave, Westminster, CO 80234: On or before August 22, 2017, the exposing employer did not ensure that employees were not exposed to overhead struck-by hazards from materials and equipment in that employees were not provided and required to wear hard hats while working on the ground and first story roof levels of a residential re-roofing project. Materials and equipment creating struck-by hazards on the first and second story roof levels included but were not limited to packets of roofing shingles, piles of demolished shingles, nail guns, and piles of wooden boards. This condition exposed employees to stuck-by hazards.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a) NGA Home Repairs LLC at 2010 W. 120th Ave, Westminster, CO 80234: On or before August 22, 2017, the exposing employer did not ensure that employees were not exposed struck-by hazards from flying particles in that employees were not provided and required to use eye or face protection, while using nail guns at a residential re-roofing project. The use of nail guns could potentially create flying particle struck-by hazards from shingles, wood, and nail ricochet. This condition exposed nail gun operators and nearby employees to struck-by hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) NGA Home Repairs LLC at 2010 W. 120th Ave, Westminster, CO 80234: On or before August 22, 2017, the exposing employer did not ensure that employees were protected from injury, in that employees conducting residential re-roofing were not utilizing a fall protection system when working around unguarded edges on a low slope roof. This condition exposed employees to falls varying from approximately 10 to 19 feet in height.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a) NGA Home Repairs LLC at 2010 W. 120th Ave, Westminster, CO 80234: On or before August 22, 2017, the exposing employer did not ensure that employees were protected from injury, in that employees were not effectively trained to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. Employees conducting residential re-roofing were not utilizing a fall protection system when working around unguarded edges on a low sloped roof. This condition exposed employees to falls varying from approximately 10 to 19 feet in height.     Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: 1) The nature of fall hazards in the work area; 2) The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; 3) The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  4) The role of each employee in the safety monitoring system when this system is used; 5) The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; 6) The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and 7) The role of employees in fall protection plans; 8) The standards contained in this subpart.
