29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment: On or about 08/14/2017, the employer did not perform hazard assessment of the workplace where employees were conducting tree trimming operation near overhead electrical lines. One of the employees sustained electrical burn on his right hand, neck and neck when he approached the electrical line. He was not equipped with personal protective equipment to avoid the burn.

29 CFR 1910.333(c)(3)(i)(A): When an unqualified person is working in an elevated position near overhead lines, the location shall be such that the person and the longest conductive object he or she may contact cannot come closer to any unguarded, energized overhead line than the following distances: (1) For voltages to ground 50kV or below - 10 feet (305 cm); (2) For voltages to ground over 50kV - 10 feet (305 cm) plus 4 inches (10 cm) for every 10kV over 50kV. (A) On or about 8/14/2017, the employer did not ensure that unqualified personnel working in an elevated position and the longest conductive objects maintained the required distance from any unguarded, energized overhead power line.

However, for line-clearance tree trimming operations performed by line-clearance tree trimmers who are not qualified employees, only one trained person need be available if all new employees are trained in first aid within 3 months of their hiring dates. On or about 08/14/2017, tree trimmers were not given training in first aid.
