29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. a) On or about 8/23/2017 at the corner of Bedford St. and Carmine St. an EMPIRE CITY SUBWAY COMPANY (LIMITED) employee was exposed to excessive noise while using a Chicago Pneumatic jack hammer to break concrete and was not mandated by the employer to utilize hearing protection.
