OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards when operating a forklift without using the seatbelt. a. On or about August 11, 2017, at the hotel parking lot, an employee did not use the installed seatbelt of the forklift when operating it to move building materials which exposes the employee to struck by hazards if the forklift were to overturn.

On or about August 11, 2017, at the hotel parking lot, the horn and backup alarm of a forklift did not function and an employee operated the forklift to move building materials which exposes employees to struck by hazards.
