29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:    (a) On or about 8/24/17, employees of The Factory East Inc. working at 723 Kent Avenue were exposed to respiratory hazards during painting and woodworking. This is because the employer had not developed a written respiratory protection program that included the provisions of the respiratory protection standard. Employees were required to use respirators during spray application of paints, as well as during sanding and buffing of wood and fiberboard.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:    (a) On or about 8/24/17, employees of The Factory East Inc. working at 723 Kent Avenue were exposed to respiratory hazards during painting and woodworking. This is because the employer had not ensured that employees had been medically cleared to wear a half-face, elastomeric respirator. Employees were required to use these respirators during spray application of paints, as well as during sanding and buffing of wood and fiberboard.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):    (a) On or about 8/24/17, employees of The Factory East Inc. working at 723 Kent Avenue were exposed to respiratory hazards during painting and woodworking. This is because the employer had not ensured that employees were fit tested if they were required to use N-95 filtering facepiece respirators and half-face elastomeric respirators, which are both tight-fitting. Employees were required to use respirators during spray application of paints, as well as during sanding and buffing of wood and fiberboard.
