29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  Employees engaged in roofing activities using a Caterpillar TH460B telescopic forklift on the job site were exposed to struck-by hazards in that the employer did not ensure that each operator had successfully completed the training.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Employees engaged in residential roofing activities from a 10/12 pitch roof were exposed to fall hazards of approximately 12 feet from the eave of the residence to the ground below in that fall protection was not utilized.
