29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): a) On August 22, 2017, employees working in an excavation up to approximately 9.1 feet in depth were exposed to cave-in hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) On August 22, 2017, employees working in an excavation exposed to struck-by hazards were not wearing hard hats. Capps Plumbing and Sewer, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a) which was contained in OSHA inspection number 983433, citation 1, item 1, and was affirmed final order on July 22, 2014, with respect to a workplace located at 828 Graceland Ave., Des Plaines, IL. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
