29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. There was no frequent and regular inspection program being maintained in use by a competent person to ensure the jobsite, materials and equipment such as elevated truss work fall protection systems or devices were being installed and maintained in a safe condition.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person. Located along the perimeter exterior a side rea of the commercial structure an employee was observed working from a Traverse Lift model F-844 rough terrain forklifts supported and elevated scaffold platform with three open and unprotected sides or edges which was not erected and used under the supervision of a competent person, in that a competent person qualified in scaffold erection did not supervise installation of standard guardrails or equivalent to ensue such systems were erected or properly utilized.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Located along the perimeter exterior a side rea of the commercial structure an employee was observed working from a Traverse Lift model F-844 rough terrain forklifts supported and elevated scaffold platform with three open and unprotected sides or edges which were not protected by guardrails or other equivalent fall protection system exposing the employee to a fall potential in excess of 10 feet.

Except as provided in 1926.500(a)(2) or in 1926.501 (b)(1) through (b)(14), each employee on a walking/working surface 6 feet (1.8 m) or more above lower levels shall be protected from falling by a guardrail system, safety net system, or personal fall arrest system. Located along a side area of the commercial structure an employee was observed performing truss framing associated work activities from the top cord of the trusses, stud wall top plate, truss lateral bracing and a structural steel beam without conventional fall protection or equivalent and was exposed to fall hazards in excess of 14 feet.
