29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: At the commercial construction site located at 6301 N Klamm Rd, Kansas City, MO 64151: Employees were exposed to fall hazards. Employees engaged in trash dumping operations had not been trained to recognize, evaluate and control exposure to fall hazards. Employees did not recognize and avoid unsafe work conditions while working from heights above 6 feet on a balcony which had no guardrails and employees had no fall arrest system to protect from fall hazards. The employees also did not know the dangers of working from an elevated height without the use of fall protection. Employees had not been trained on the hazards associated with their job site.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. At the commercial construction site located at 6301 N Klamm Rd, Kansas City, MO 64151: Employees were exposed to fall hazards. Fall protection was not provided to employees working above 6 feet on a commercial construction site. Employees were taking out trash from the 2nd and 3rd floor apartment building by way of the balconies; these balconies did not have a guardrail in place to protect the employees from falling approximately 50 to 60 feet to the ground below.
