29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: Employees in the warehouse were exposed to a serious struck by hazard from the forklift that was in operation. Forklift brakes did not immediately stop forklift when dead man brake pedal was released. Including but not limited to the Schaeff Namco Inc forklift, Serial Number 8506001, Model number F202411, known to the company as forklift #45. Forklifts not in safe operating condition were not removed from service as required.
