29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  (a)  Back of the house - On or about August 23, 2017 two employees were exposed to a fall hazard while climbing on a scaffold 19 feet 2 inches above ground with no ladder installed.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. 29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  (a)  Parker Plastering - On or about August 23, 2017 the employer did not train each employee exposed to various hazards associated with construction on how to recognize and minimize these hazards. The employer stated he did not provide training to his employees to avoid unnecessary injuries on this construction site.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  (a) Back of the house - On or about August 23, 2017 two employees were exposed to a potential fall hazard due to the fact a scaffold 19 feet 2 inches above the ground was not inspected prior to use. This scaffold: 1) had no base-plates 2) had no guardrails 3) had no ladder 4) was not fully decked or planked.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  (a)  Parker Plastering - On or about August 23, 2017 the employer did not train each employee exposed to various hazards associated with scaffolds on how to recognize and minimize these hazards. The employer stated he did not provide training to his employees to avoid unnecessary injuries while working on scaffolds.
