29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices ("MUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA. a) On August 23, 2017, the employer did not conform to the Manual on Uniform Traffic Control Devices, Millennium Edition, Section 6F.21, when approaching north bound IL RT 25 motor traffic road users were not warned of a right lane closure and south bound IL RT 25 motor traffic road users were not warned of a left lane closure. Employees working in and near the traveled way were being exposed to struck-by motor vehicles. b) On August 23, 2017, the employer did not conform to the Manual on Uniform Traffic Control Devices, Millennium Edition, Section 6G.03, when approaching motor traffic road users on south bound IL RT 25 and on Galena BLVD (EB/WB lanes) were not warned of road construction work ahead. Employees working in and near the traveled way were being exposed to struck-by motor vehicles. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, 1988 Edition, Revision 3 or the Millennium Edition. On August 23, 2017, the employer did not conform to the Manual on Uniform Traffic Control Devices, Millennium Edition, Section 6E.04, when approaching motor traffic road users were not directed by flaggers using a STOP/SLOW paddle or a flag. Employees working in and near the traveled way were hand signaling road users while being exposed to struck-by motor vehicles. There is no abatement certification or documentation required for this item.
