29 CFR 1926.501(a)(2): The employer did not determine if the walking/working surfaces on which its employees were to work on, had the strength and structure integrity to support employees safely: On or about August 25, 2017, the employer did not assess and determine if the roof of a commercial vehicle had the strength and structural integrity to support employees safely. An employee was using the roof of a commercial vehicle as a walking/working surface while scraping paint from the underside of a fueling station canopy.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On August 25, 2017, an employee was exposed to a fall hazard without fall protection while scraping paint from the underside of a fueling station canopy. The employee was using the roof of a commercial vehicle as a walking/working surface. The commercial vehicle was 16 feet long, 8 feet wide and 9.5 feet high.
