Section (5)(a)(1): The employer failed to furnish to each of his employees employment and a place of employment which was free from recognized hazards that were causing or are likely to cause death or serious physical harm, in that employees were exposed to fire and explosion hazards: (a) On or about August 23, 2017, for the employees exposed to fire and explosion hazards where a Skyjack scissor lift, model no. SJIII3219, serial no. 22062057, was operated in a hazardous location to facilitate maintenance in the CRYO 2 area at 3507 149th Avenue, Alexander, North Dakota. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard would be for the employer to develop and enforce workplace inspection procedures to include those for determining hazardous location prior to operating scissor lifts as stated in American National Standard of Self-Propelled Elevating Work Platforms, ANSI/SIA A92.6-2006, Section 7 Responsibilities of Users, and Paragraphs 7.8 7.10 and Fire Safety Standard for Power Industrial Trucks Including Type Designations, Areas of Use, Conversions, Maintenance, and Operations, NFPA 505-2013.

29 CFR 1910.178(c)(2)(iii): Power-operated industrial trucks other than those designated as EX were used in atmospheres containing chemicals referenced in this section in quantities sufficient to produce explosive or ignitable mixtures and where such concentrations of these gases or vapors exist continuously, intermittently or periodically under normal operating conditions or may exist frequently because of repair or maintenance operations: (a) On or about August 23, 2017, for the employees exposed to fire and explosion hazards where a propane powered Toyota forklift, model 8FGU25, serial no. 36345, was operated in a hazardous location to facilitate maintenance in the CRYO 2 area at 3507 149th Avenue, Alexander, North Dakota.
