29 CFR 1926.62(g)(2)(i): The employer did not provide the protective clothing required in 29 CFR 1926.62(g)(1) in a clean and dry condition at least daily for employees whose exposure levels, without regard to respirator use, were over 200 micrograms per cubic meter of lead as an 8-hour time weighted average (TWA): a) Barge Unloader Demo Area: On or about July 14, 2017 creating and exposing employer, D. H. Griffin Wrecking Co. Inc. exposed employees of Global Rigging and Transport LLC to lead at an 8 hour calculated Time Weighted Average (TWA) of 268 micrograms per cubic meter of air which is 5.36 times the 8 hour time weighted average PEL of 50 micrograms per cubic meter of air while conducting cutting torch job tasks and was not provided clean and dry protective coveralls daily.

29 CFR 1926.62(i)(3)(i): The employer did not provide shower facilities, where feasible, for use by employees whose airborne exposure to lead was above the permissible exposure limit: a) Barge Unloader Demo Area: On or about July 14, 2017 creating and exposing employer, D. H. Griffin Wrecking Co. Inc. exposed employees of Global Rigging and Transport LLC to lead at an 8 hour calculated Time Weighted Average (TWA) of 268 micrograms per cubic meter of air which is 5.36 times the 8 hour time weighted average PEL of 50 micrograms per cubic meter of air while conducting cutting torch job tasks and was not provided shower facilities were feasible. b) Barge Unloader Demo Area: On or about July 14, 2017 and at times prior to, the creating and exposing employer, D. H. Griffin Wrecking Co. Inc. exposed employees of Global Rigging and Transport LLC to lead at an 8 hour calculated Time Weighted Average (TWA) of 125 micrograms per cubic meter of air which is 2.5 times the 8 hour time weighted average PEL of 50 micrograms per cubic meter of air while conducting cutting torch job tasks and was not provided shower facilities were feasible.

29 CFR 1926.350(a)(10): Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire resistance rating of at least one-half hour. a) Roof area: On or about August 28, 2017 employer exposed employees to fire, burns and struck by hazards by not separating oxygen gas tanks from propane tanks a minimum distance of 20 feet.
