29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New townhome construction located on Lot #7, Roof trusses: On or about 08/28/2017, and at times prior, the employer exposed employees to fall hazards of over 28-feet from the lower ground level, in that a fall protection system was not provided to employees engaged in truss framing activities. (b) New townhome construction located on Lot #7, Roof deck: On or about 08/28/2017, and at times prior, the employer exposed employees to fall hazards of over 37-feet while working on a 12/12 pitch roof, in that a complete fall protection system was not provided or used by employees installing plywood sheathing.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) New townhome construction located on Lot #7, Roof: On or about 08/28/2017, and at times prior, the employer had exposed employees to fall hazards over 28-feet while engaged in framing and sheathing activities, in that the employer failed to provide fall protection training to employees working at heights over 6-feet.
