29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.   The employer, JC Construction, did not submit to the agency documents demonstrating that abatement is complete for each serious violation for which the Agency indicates in the citation that such abatement documentation is required, on our about February 23, 2018.  More specifically JC Construction did not submit to the agency documents demonstrating that employees engaged in roof work at an elevated height, were both tied off to a single anchor point and not wearing protective eyewear while utilizing a pneumatic hand-held nail gun, required by 1926.102(a)(1) and 1926.502(d)(15).

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  a) Exterior Roof: Employees engaged in roofing work were using a pneumatic nail gun without eye protection. The employer did not ensure that employees were using eye protection, thus exposing employees to an eye injury, on or about, 7/28/17.

29 CFR 1926.502(d)(15): Anchorage points used for attachment of personal fall arrest equipment were not  independent of any anchorage point being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee:  a) Exterior Roof: Employees engaged in roofing work were wearing personal fall arrest equipment and not independently tied off to an anchorage point. The employer did not ensure that employees using personal fall arrest equipment were independently tied off to an anchor point, on or about, 7/28/17.
