OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and caught between hazards:  On or about August 27, 2017 employees were exposed to struck-by and caught between hazards where the employer failed to ensure that employees were not in the danger zone when pressure treatment cylinders were being loaded with product on tram cars by powered industrial trucks or a winch system.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CRORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.146(d)(3)(iii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including isolating the permit space:  On or about August 28, 2017, employees entering treatment cylinders to wash them out when changing treatment chemicals were exposed to hazards associated with permit required confined space entry where the employer did not develop and implement permit entry procedures.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.146(d)(3)(v): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit entry operations, including providing pedestrian, vehicle, or other barriers as necessary to protect entrants from external hazards:  On or about August 28, 2017 employees entering treatment cylinders to wash them out when changing treatment chemicals were exposed to hazards associated with permit required confined space entry where the employer did not provide and ensure the use of pedestrian, vehicle, or other barriers at the cylinder door and pit to prevent forklift or winch operators from loading the cylinder during entry.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVVE ACTION WORKSHEET).

29 CFR 1910.146(e)(1): Before entry was authorized, the employer did not document the completion of measures required by 29 CFR 1910.146(d)(3) by preparing an entry permit:  On or about August 28, 2017 employees entering treatment cylinders to wash them out when changing treatment chemicals were exposed to hazards associated with permit required confined space entry where the employer did ensure permit entry procedures were documented on a confined space entry permit prior to entry being made into a space with both atmospheric and non-atmospheric hazards.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVVE ACTION WORKSHEET).

29 CFR 1910.146(g)(1): The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146:  On or about August 28, 2017 employees entering treatment cylinders to wash them out when changing treatment chemicals were exposed to hazards associated with permit required confined space entry where the training the employer provided to employees instructed them to reclassify the treatment cylinders as non-permit spaces for entry and reclassification did not address non-atmospheric hazards.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVVE ACTION WORKSHEET).
