OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that  an employee's finger was caught between the top of the fork frame and the carriage.        On or about June 01, 2017, an employee who used his hand to stabilize himself as he was being elevated on the fork blades of the company's Aisle-Master fork truck: model 33SE, serial number 31735 was not protected from hazards created by the articulating/tilting action of the forks and thus sustained an amputation injury when his finger was caught between the top of the fork frame and the carriage.

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours:      The employer failed to report an amputation injury within (24) twenty-four hours as required. On or about June 01, 2017, an employee who used his hand to stabilized himself as he was being elevated on the fork blades of the company's Aisle-Master articulating fork truck sustain an amputation injury when his finger was caught between the top of the fork frame and the carriage. The amputation was not report until August 10, 2017.

29 CFR 1910.157(e)(1): The employer shall be responsible for the inspection, maintenance and testing of all portable fire extinguishers in the workplace:         On or about August 16, 2017, the employer failed to inspect and/or maintain portable fire extinguishers at the company's warehouse located at 4855 W. 130th St., in Cleveland, OH. All of the portable fire extinguishers observed during the walk-around inspection of the warehouse area had 2013 tags.

The employer was first made aware of the amputation injury on 06/22/2017, through a First Report of Injury Report from the Ohio Bureau of Worker's Compensation however; as of 10/19/2017 the recordable injury or illness had not been annotated/recorded on the company's 300 forms.
