29 CFR 1910.23(c)(8): The employer must ensure the cap (if equipped) and top step of a stepladder are not used as steps. On or about August 28, 2017, employees were exposed to a fall hazard while using the cap of a stepladder to access the tops of 7 foot index tanks to complete work activities. The employer did not ensure that the top cap of a stepladder was not used as steps. Abatement certification is required for this item in accordance with the requirement of 29 CFR 1903.19(c).

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by guardrail systems, safety net systems, or personal fall arrest systems. On or about August 28, 2017, employees were exposed to fall hazards while working on the top of 7 foot index tanks to secure metal covers at the of edge of the tank. The employer did not ensure that each employee was protected from a fall by guardrail systems, safety net systems, or personal fall arrest systems while working on the top of index tanks. Abatement documentation is required for this item in accordance with the requirement of 29 CFR 1903.19(d).
