29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employer:   a. On or about August 29, 2017 at the above referenced worksite, safety inspections were not made by persons trained to identify and correct recognized hazards. As a result, corrective action was not taken with regard to fall hazards, falling objects, and deficiencies in personal protective equipment.  There is no abatement certification or documentation required for this item.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about August 11, 2017 at the above referenced worksite, employees had not been provided effective training to recognize fall hazards and procedures to minimize hazards prior to being assigned to residential roofing operations on a two story sloped roof.  Employees were exposed to fall hazards of up to 25 feet.  There is no abatement required for this item.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. On or about August 29, 2017 at the above referenced worksite, employees engaged in residential roofing were required to use a portable ladder that was not extended at least 3 feet, and that was not secured from tipping while accessing the roof. Employees were thereby exposed to a fall hazard of up to nine feet to a concrete surface.   There is no abatement certification of documentation required for this item.

29 CFR 1904.40(a): Basic requirement. When an authorized government representative asks for the records you keep under Part 1904, you must provide copies of the records within four (4) business hours.  a. On or about August 29, 2017 at approximately 1530 documents were requested during conversation with employers legal counsel. The employer failed to respond to said request within four hours.  b. On or about September 06, 2017 a written document was e-mailed to the employer and their legal counsel. The employer failed to respond to this request.  c. On or about September 22, 2017 a written document request was delivered to employer with a response required by September 29, 2017. The employer failed to reply to this request.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
