29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    a) On or about 08/28/2017 - 4537 River Park Blvd SE, Owens Cross Roads, AL, employees working from a constructed wood scaffolding system composed of 2"x4" and 2"x 6" preparing to install facia along the ends of the 2"x 6" rafters were unprotected from falls at approximately 16 feet above the ground.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  a) On or about 08/28/2017 - 4537 River Park Blvd SE, Owens Cross Roads, AL, employees working from a constructed wood scaffolding system composed of 2"x4" and 2"x 6" preparing to install facia along the ends of the 2"x 6" rafters at 16 feet above the ground unprotected from falls were unware of the hazards.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.    a) On or about 04/28/2017 - 4537 River Park Blvd SE, Owens Cross Roads, AL, an employee installing a 2"x4" stud to support a scaffolding system was hanging outside of a window opening from the second floor of a residential home at approximately 13 feet above the ground unprotected from falls.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) On or about 08/28/2017 - 4537 River Park Blvd SE, Owens Cross Roads, AL, employees installing 4'x8' sheets of plywood over rafters at approximately 11 feet above the ground were unprotected from falls.     Oscar Soto Framing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1212614, citation number 1, item number 1a and was affirmed as a final order on 03/27/2017, with respect to a workplace located at 5 Brennan Hill Lane, Huntsville, AL 35801.
