29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a. On or about August 29, 2017, at the above addressed jobsite, employees removing masonry material from the roof were exposed to falls of thirteen (13) feet two (2) inches created by the presence of unprotected sides.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a. On or about August 29, 2017 at the above addressed jobsite, an employee was operating a power industrial vehicle (PIV) during masonry operations. The employee' performance on PIV operations was not evaluated within three years. Ebben Masonry, Incorporated was previously cited for a violation of this Occupational Safety and Health Standard 1910.178(l)(4)(iii) which was contained in OSHA inspection number 1161182 , citation number 1, item number 1 and was affirmed as a final order on August 8, 2016, with respect to a workplace located at 801 7th Avenue, Libertyville, IL 60048.
