29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD"), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA, which are incorporated by reference:     (a)  On or about August 28, 2017, employees were exposed to struck-by hazards from motor vehicle traffic while working in and near the traveled way of Steven Drive in that the employer was not aware of the correct principles of proper temporary traffic control. An insufficient number and spacing of cones were used to prevent motorists from entering the work area.  Advanced warning signs were not used so as to warn and instruct oncoming motorists of the work being performed and what route to travel around the work area.  Employees were working and walking in the street area outside of the work area with no controls in place (such as flagger) to prevent being struck-by motorists.     Abatement Note: Among other methods, a feasible and acceptable abatement method to correct this hazard is to assign a person who is knowledgeable in the principles of proper temporary traffic control and ensure that all temporary traffic control devices on the project are consistent with the traffic control plan and are effective in providing safe conditions for workers. These specific duties are outlined in the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition on page 6B-3.    Abatement Note: Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition on page 6D-1 says "The various temporary traffic control for pedestrian and worker safety set forth in Part 6 shall be applied by knowledgeable (for example, trained and/or certified) persons after appropriate evaluation and engineering judgment."

Employees exposed to public vehicular traffic shall be provided with, and shall wear, warning vests or other suitable garments marked with or made of reflectorized or high-visibility material:    (a)  On or about August 28, 2017, employees were exposed to struck-by hazards while working near a live lane of vehicular traffic without the benefit of high visibility vest or other suitable outer garments.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  (a)  On or about August 28, 2017, the employer did not ensure a competent person inspected the excavation prior to start of work and during each shift in that the competent person did not identify the lack of an appropriate protective system and did not take prompt corrective action to eliminate the cave-in hazard.  This condition exposed the employee to the hazards of working inside an unprotected trench in excess of five feet deep.  Abatement Note:  "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
