29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a)  Residential structure located at 27229 Boat Basin Road (Orange Beach, AL);  On or about August 28, 2017 and at times prior; the employer and his employee worked from a job made scaffold without fall protection exposing the employee to a fall hazard of approximately 26 feet to the ground below.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  a)  Residential structure located at 27229 Boat Basin Road (Orange Beach, AL);  On or about August 28, 2017 and at times prior; the employer exposed employees to  fall hazards when working from a job made scaffold approximately 26 feet above the ground without first being trained to recognize the hazards associated with working from the type of scaffold.

29 CFR 1926.503(a)(1): A training program was not provided to each employee who might be exposed to fall hazards, to enable that employee to recognize the hazards of falling, and be trained in the procedures to be followed to minimize these hazards:  a)  Residential structure located at 27229 Boat Basin Road (Orange Beach, AL);  On or about August 28, 2017 and at times prior; the employer exposed employees to fall hazards when framing a residential structure at heights as high as 31 feet 4 3/4 inches to the ground below.  The employer failed to train employees in fall protection methods and when fall protection should be used.
