29 CFR 1915.12(a)(1)(i): The employer shall ensure that spaces that have been sealed, such as, but not limited to, spaces that have been coated and closed up, and non-ventilated spaces that have been freshly painted; are visually inspected and tested by a competent person to determine the atmosphere's oxygen content prior to initial entry into the space by an employee: On or about August 21, 2017, the employer did not ensure that the chain locker confined space was visually inspected and tested by a competent person to determine the atmosphere's oxygen content prior to initial entry into the space by an employee. The chain locker was a non-ventilated space which was being coated with an epoxy paint and had previously been coated and closed up.
