29 CFR 1910.178(m)(5)(ii): A powered industrial truck shall not be left unattended when the operator is 25 ft. or more away from the vehicle which remains in view, or whenever the operator leaves the vehicle and it is not in view. On or about August 29, 2017, the employer failed to ensure that a powered industrial vehicle (Tug #14, serial # 2019431), remained under the control of the operator, within at least a 25 foot perimeter. The powered industrial vehicle was left running and unattended numerous times due to the engine not being able to be shut off frequently due to a defect in the engine.

29 CFR 1910.178(p)(1): Powered industrial truck(s) with defect(s) or in any way unsafe had not been withdrawn from service until restored to safe operating condition(s): On or about August 29, 2017, the employer failed to ensure that a powered industrial vehicle (Tug #14, serial # 2019431), which was found to have some mechanical defect (fly wheel broken ) was not taken out of service and repaired prior to being operated. Employees were leaving the engine hood off so that they could reach inside with an allen wrench and manually turn the fly wheel so that it can be properly aligned to allow the vehicle to be started. The vehicles hood remained off during operation due to this. The vehicle also was not able to be shut down often so it was left running numerous times.
