29 CFR 1910.134(d)(3)(i)(B)(1): The employer did not select a respirator for employee use that maintained the employee's exposure to the hazardous substance, when measured outside the respirator, at or below the maximum use concentration: (Construction Reference 1926.103)     a.  On or about August 29, 2017, building exterior, an employee was required to wear a half mask respirator during grinding of concrete surfaces and the maximum use concentration for a half mask respirator and respirable dust containing 9.6% Crystalline Silica (Quartz) was exceeded and exposes the employee to Crystalline Silica (Quartz).

29 CFR 1910.134(l)(2)(iii): Proper respirator use under the workplace conditions encountered by the employee was not included in the assessment of program effectiveness:  (Construction Reference 1926.103)       a.  On or about August 29, 2017, building exterior, the employer did not ensure an employee wore a half mask respirator according to the respirator manufacturers instructions.  The employee was required to wear a respirator during grinding of concrete surfaces which exposes the employee to Crystalline Silica (Quartz).

29 CFR 1910.1200(g)(10):  The employer did not ensure that, in all cases, the required information was provided for each hazardous chemical, and was readily accessible during each work shift to employees when they were in their work area(s): (Construction Reference: 1926.59)    a.  On or about August 29, 2017, at the building site, the employer did not ensure copies of the required safety data sheets were readily accessible for hazardous chemicals in the work place including but not limited to ready mix concrete and Dayton Superior Sure Lift with Dye J6D.
