29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:        a)  On or about 08/28/17, on jobsite at a house at 2974 Lockport  Olcott Rd., Newfane , NY:  Employees   were  exposed  to a potential fall of approx. 17 ft.  from  the pik on a Ladder Jack Scaffold  erected on the right side of the house while standing on the pik engaged in roof tear-off  work.  No Fall protection system was being utilized.          NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:      a) On or about 08/28/17, on the upper roof of a house at  2974 Lockport  Olcott Rd., Newfane, NY: Five employees engaged in roofing tear-off work on a steep roof on the right side of the house were exposed to a fall of approx. 20 foot.  No fall protection system was being utilized.  Pitch of the roof was approx. 8 in 12.       NO ABATEMENT CERTIFICATION REQUIRED

Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system alone:   a) On or about 08/28/17, on the low slope porch roof of a house at 2974 Lockport  Olcott Rd., Newfane , NY:  Two employees  engaged in roofing work were exposed to a fall of approx.  12 ft.  No fall protection system was utilized on this roof.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.      a) On or about 08/28/17, on the front side of a house at  2974 Lockport  Olcott Rd., Newfane , NY: Employees used an extension ladder to access the porch roof from the ground. The side rails of that ladder only extended approx.  12 inches above the roof.     b) On or about 08/28/17, on the front side of a house at  2974 Lockport  Olcott Rd., Newfane , NY:  An employee used the support ladder of a Ladder Jack Scaffold erected on the porch roof to exit the upper roof onto the scaffold pik. The side rails of that support ladder only reached to the bottom of the gutter which was below the roof edge.       NO ABATEMENT CERTIFICATION REQUIRED
