29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-in. (a) On or about August 31, 2017, the employer did not accomplish an inspection of the trench and adjacent areas prior to the start of work, and during excavation activities to identify changing soil conditions and need to implement the use of a protective system.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) On or about August 31, 2017, employees working in a six (6) foot 10 inch deep trench for the purpose of installing sewer lines had not been protected from cave-ins by a protective system. This exposed employees to crushing hazards.
