OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees; On or about September 1, 2017, the employer failed to ensure that employees were protected from injuries caused by falls in that they were exposed to hazards associated with climbing onto forklifts with raised, unsecured loads and without fall protection to prevent a fall from height.
