Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: On or about September 1, 2017 an employee was exposed to a fall hazard of approximately 17 feet while elevated on a Terex rough terrain forklift without a personnel work platform or fall protection.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502: On or about September 1, 2017 an employee engaged in sheathing installation on a two-story new construction home did not utilize fall protection and was exposed to fall hazards of 20 feet from the roof eave to the ground below.
