29 CFR 1926.1417(c)(1): The procedures applicable to the operation of the equipment, including rated capacities (load charts), recommended operating speeds, special hazard warnings, instructions, and operator's manual, were not readily available in the cab at all times for use by the operator: Construction site, Crane operation: On or about August 29, 2017, and at times thereto, employees were exposed to a struck-by hazard while the Kobelco Crawler Crane, Model 7150, was being operated without the correct rated capacity chart (load chart).

29 CFR 1926.1412(d)(2): If any deficiency in paragraphs (d)(1)(i) through (xiii) of this section (or in additional inspection items required to be checked for specific types of equipment in accordance with other sections of this standard) is identified, an immediate determination was not made by the competent person as to whether the deficiency constitutes a safety hazard. If the deficiency is determined to constitute a safety hazard, the equipment was not taken out of service until it has been corrected: a) Construction site, Crane operation: On or about August 29, 2017, and at times thereto, employees were exposed to a struck-by hazard while the Kobelco Crawler Crane, Model 7150, was being operated with a Hydraulic leak. b) Construction site, Crane operation: On or about August 29, 2017, and at times thereto, employees were exposed to a struck-by hazard while the Kobelco Crawler Crane, Model 7150, was being operated with a defective front windshield wiper. c) Construction site, Crane operation: On or about August 29, 2017, and at times thereto, employees were exposed to a struck-by hazard while the Kobelco Crawler Crane, Model 7150, was being operated with a defective fuel gauge indicator.
